Most contractors do not know what their marketing agreement actually says. That is not a failure of attention — these documents are written to be skimmed, and the clauses that cost the most are rarely the ones in bold.

The clauses we look for first

Who the domain is registered to

If the agency registered your domain in their own name, they own your web address. Every customer who has ever typed it, every review that points at it, every ranking it has earned — all of it is theirs to switch off. This is the single most damaging clause in the trade and it is almost never mentioned in the sales call.

Whether your leads are exclusive

Shared-lead platforms sell the same homeowner to several contractors at once. You are not buying a customer, you are buying a place in a race. Read carefully for the words non-exclusive, matched, or up to four providers.

What leaving costs

Look for automatic renewal, notice periods measured in months, early-termination fees, and any charge to release your own files or ad accounts. A fair agreement makes leaving boring.

Whether the ad spend is marked up

If your advertising budget goes through the agency's account rather than your own, you cannot see what the platform actually charged. Ask for the platform's own spend report. An agency that will not show it is telling you something.

Who owns the customer list

Your past customers are the most valuable asset your business has. Some agreements quietly treat the CRM and its contents as the agency's property.
